Do you need a medical marijuana card to purchase hemp-derived cannabinoids?
Navigating the world of cannabis products often brings up questions about legality and whether a medical card is necessary for purchase or possession. The simple answer is NO, you don't need a medical card to buy Delta 8, HHC, or CBD. However, in certain states, you might require medical authorization to purchase Delta 9 THC products, if they're even legal there.
What's the legal difference between cannabinoids?
In 2018, the US Federal Government passed the "2018 Farm Bill" which regulated cannabis production and clarified the definition of "hemp." Essentially, this legislation stated that any cannabis plant or product containing less than 0.3% Delta 9 THC would be considered federally legal hemp, not cannabis.
This means that products containing higher levels of HHC, Delta 8 THC, CBD, and other cannabinoids, with only trace amounts of Delta 9 THC, became legally available nationwide. Some states later enacted their own bans or regulations on some of these compounds, while others didn't pass any additional laws or even legalized and regulated these cannabinoids, albeit with some oversight from state agencies.
Currently, Delta 9 THC remains illegal in many states (and federally), making it unlawful to possess or purchase. Some states have established medical card programs and dispensaries for traditional Delta 9 cannabis, while others have recreational dispensary networks accessible to adults over 21. Some offer both with variations in available products for each group.
Given the complexity and frequent changes in these laws, it's important to check your state's regulations before buying or possessing these products.
Where can you buy Delta 8, HHC, or CBD?
In states where hemp-derived cannabinoids are legal, you'll likely find them in smoke shops, CBD stores, and head shops. Some markets have seen these products become popular enough to be sold in convenience stores, gas stations, and other various retail locations. While you may need to show ID to prove you're 21 or older in certain places, no specific card or license is necessary.
